Traffic Speeding Statistics are Harrowing throughout the US and in Monroe County, NY

Did you know that hundreds of thousands of people are catastrophically injured and more than 42,000 people lose their lives in traffic crashes every year in this country? In fact, the National Highway Traffic Safety Administration reports car, motorcycle, bus and truck accidents are the leading cause of death for individuals ages three to 33.

It is for these reasons that police officers and municipal judges take traffic laws and violations extremely seriously in Rochester and the surrounding towns. It stands to reason that when drivers speed, they often are unable to stop in time to avoid a collision. Additionally, accidents that involve high speeds cause considerably more damage to property and people. When an accident occurs at a high rate of speed, the driver and passenger will not get most of the intended benefits of the vehicle’s safety equipment (airbags and seatbelts) either.

Throughout New York, speed limit signs are posted on roadways. Failure to travel the speed limit will likely result in a serious traffic ticket. This is because police are on the lookout for speeders; more than 200 sheriff’s offices across New York have joined with municipal organizations to participate in a program called Selective Traffic Enforcement in which speeders are targeted and ticket.

What are the Penalties for Speeding in New York?

The driver of a non-commercial vehicle (cars and motorcycles) face the following consequences if convicted of speeding in New York.

  • Up to 10 mph over the speed limit: Between $90-$150 in fines and up to 15 days in jail
  • More than 10 mph over the limit but less than 30 mph over the limit: Between $180-$300 in fines and up to 30 days in jail
  • More than 30 mph over the limit: Between $360-$600 in fines and up to 30 days in jail

Fines are always doubled in work zones. And, rest assured, repeat speeding offenders face even tougher penalties. You will pay more in fines if you are convicted of more than one speeding charge in an 18 month period.

In addition to fines and possibly jail time, any driver convicted of speeding in New York will have points on their driver’s license.

  • 1-10 mph – 3 points
  • 11-20 mph – 4 points
  • 21-30 mph – 6 points
  • 31-40 mph – 8 points
  • More than 40 mph – 11 points

If you accrue 11 points in an 18 month period, your license can be suspended. After six points, you may be forced to pay the New York Driver’s Responsibility Assessment penalty.

Do the math: if you are ticketed for speeding and convicted of the charge, your driving privileges are seriously in danger. This is because police officers often issue more than one traffic violation on a stop. If you were exceeding the speed limit considerably, the cop may also slap you with a careless driving ticket. Or, if you sped through a red light, that ticket comes with points too. As you can see, accumulating 11 points can happen before you know it.

The attorneys at LaDuca Law Firm know the laws and the court system. We work everyday in the municipal traffic courts in Monroe County, NY and we will fight your speeding charges. We will negotiate with the prosecutor to get your tickets merged to lessen the number of points you receive. Whenever possible, we will seek to discredit the evidence to get your charges dismissed entirely.

Contact our office today for a free consultation about your ticket. We can stand up for you in court (whether you are local or from out of the region or state). We will protect your rights and fight to allow you to keep your driver’s license. Don’t wait, call today.
