What are the Consequences of a Driving While Intoxicated Ticket in New York?

If you are suspected of drunk driving and get pulled over by a police officer in Upstate New York, you may be arrested and charged with DWI. You will be taken back to the station where you will be required to take a Breathalyzer test. If you are found to have a blood alcohol content (BAC) of .08 or higher, you will be charged with DWI. If you were driving commercial vehicle (such as a bus or a truck) the permitted BAC limit is .06 percent.

If you are found guilty of DWI/DUI you will lose your driving privileges for a minimum of six months. A person with a CDL will have their license suspended for one year. Not having the ability to drive will stop you from getting to and from work, school and any other activities that are part of your daily lifestyle. You will be forced to depend on others or public transportation.

Further, your freedom may literally be at stake. The judge can opt to send you to prison for up to one year. He or she can also give you probation. While these penalties are at the judge’s discretion for a first time offense, the chances of you serving jail time is increased the higher your BAC reading turned out to be or if there was considerable property damage or personal injury caused by your drunk driving.
